Many pro choice women will not support Senator McCain because the media has told them that he wants to overturn Roe v. Wade and make abortions illegal. This is not true at all. Here are the facts about Roe v. Wade. Keep in m ind, I too, am pro choice.
Yes, McCain does want to overturn Roe v. Wade but he cannot--- the Supreme Court justices are the only ones able to overturn it. Yes, he plans to appoint justices that will agree with him. However, the Congress is controlled by democrats and the Congress must approve the President's Supreme Court appoitments. There is no chance that a democratic controlled Congress will approve extremely conservative justices and thus, Roe v. Wade will never be overturned.
That being said, there is a small chance McCain will be able to make these appointments. If, in fact, this does happen, and McCain is able to appoint his conservative judges and Roe. v. Wade is overturned, abortions will NOT, I repeat will NOT be illegal. Overturning Roe v. Wade will allow abortion laws to be left up to the states. Do you think your state will make abortions illegal? Chances are, not many states will. And if your state does make abortions illegal, you will be allowed to pass a state border and get an abortion in another state.
That being said, is abortion really the key issue at stake this election? President Bush is way more pro life then McCain ever will be and he didn't manage to do anything about it. If he didn't, trust me... neither will McCain. Like I said, very small chance, and even if something does happen, abortions will still be legal.
That being said again, the Constitution does not mention a single word about abortion. The federal law is strictly supposed to abide by the Constitution and the Constitution alone. Abortion is not in the constitution, and therefore should remain at a state level. Allowing the federal government to control issues not mentioned in the Constitution denies the states of their rights, disregarding the whole point of a democracy.
